THE HERALD-NEWS, WEDNESDAY, JULY 7, 1965 Britain Laborites Lose Three Votes By COLIN FROST LONDON AP) Spokesmen for Britain's Labor government said today that Prime Minister Harold Wilson would not resign despite three staggering, defeats in the House of Commons. The spokesmen said the issue at stake was not considered vital to the government's It was clear, however, that the government had suffered great embarrassment and its floor managers in Commons had been outwitted. The Conservatives apparently had tricked a number of Labor members into going home too early. The votes came early during debate on the government's finance bill embodying stiffer taxes and a new system of company taxation. The votes added a clause limiting the effect of the new capital gains tax on mutual funds.

Chenoweth last night made it clear that the Town Commission has no jurisdiction in the proposed major subdivision of the Feland property on The Enclosure, which 1 has stirred adverse reactions among residents of the street off Passaic Avenue. Chenoweth said the Planning Board, by authority of the state's enabling act, has final decision in matters of subdivision, be it minor or major. Those who seek remedy against subdivision approval by the Planning Board must apply directly to the courts, the mayor added. A few residents of The Enclosure were present at the commission meeting yesterday, but they chose not to speak after the mayor's announcement. In reply to one question, Chenoweth said that the town attorney has informed him that 1 he "probably cannot vote" in this matter.

The mayor is a member ex-officio the Planning Board. In their meeting tomorrow night, the planners are expected to vote on the application by Frank L. Samara, a Franklin Avenue businessman who recently acquired the large Feland property, to subdivide the lot into parcels arranged in semi circle at the Samara dead end of Enclosure. plans to erect eight one family homes on the sub-lots all of adequate size according to the ordinance. The process would involve the destruction of the old Feland Heme, dating back to 1840 and described as a structure of historic importance.

Nearly 160 residents showed up at the public hearing on the application three weeks ago held by the Planning Board. Mrs. Florence E. Rutan, town clerk, informed the commission members that she has since received three additional letters stating opposition to the application. In another matter, Commissioner Roy Gundersdorff, director of public affairs, read a notice to property owners regarding well water.

He said state rules now provide that well water must be tested bacteriollogically and and domestic found safe for purposes; that the water from the town supply is shut off at the curb and the water meter disconnected, and that the pump, tank and water connection to the building's water supply lines have been inspected and approved by the Health Department. A request for a bacteriological test must be to the department, Gundersdorff said. Commissioner John H. Lucy, director of public works, introduced an ordinance amending the town's existing ordinance regulating fences. A public hearing will be held August 3.

Following Davis's refusal to testify at the trial, the judge instructed the jury to consider his failure to testify as evidence he could not rebut the state's case. At the same time, the high court noted, Davis's trial lawyer improperly told the jury reasons for his client's silence.

"Such assertions are testimonial in nature and such testimony can only be given from the witness "With respect to whether the court's effort was harmful," the court continued, "we are unable to say it was not, even though evidence of guilt is quite ample." The court also ruled that the right to defend yourself in court was not absolute. In answering Davis's contention that he had asked to himself but was assigned counsel, the court said a man can only defend himself if he can do it with fairness to the state and to the judicial process. The question was up to the discretion of the trial court, the Supreme Court said.
